If your Korean fixed-term employment contract is approaching its end date, first establish whether the employer means ordinary expiry, nonrenewal, or an earlier termination. Keep the contract and renewal history, ask for the final working date and payment plan, and obtain advice if those descriptions do not match what is happening.
Checked October 18, 2026. A short notice message does not, by itself, decide the legal outcome. The contract, actual employment history, and any legally protected expectation of renewal matter.
Confirm the dates and the employer's meaning
Find the exact end date in the signed contract and every extension. Compare it with the date the employer now says you should stop working. If the employer wants you to leave before the agreed term ends, identify that clearly rather than accepting the word “expiry” without checking.
In a May 29, 2025 consultation response, MOEL explains that a fixed-term employment relationship generally ends when its term expires, absent special circumstances. The response is general guidance, rather than a ruling on your contract.
Please confirm whether the company is allowing my current contract to expire on [date], declining renewal, or proposing an earlier termination. Please also confirm my final scheduled working day and the contact for final pay and employment documents.
Keep renewal evidence before access ends
Collect your own contracts, renewal notices, relevant employment policies, and messages about the next term that you are entitled to retain. List when each contract began and ended. Identify whether renewal criteria were communicated and whether you were told you had met them.
Before accepting repeated contracts as ordinary expiry, check Article 4 of the Fixed-Term and Part-Time Workers Act. Where the Act applies, using a fixed-term worker for more than two years without an applicable exception means the worker is treated as having a contract without a fixed term. The Act has workplace-scope rules and exceptions, and special legislation can matter. Ask an adviser to assess all contract periods and any claimed exception; the printed end date alone does not answer this question.
The Supreme Court's October 28, 2021 decision, 2021두45114, distinguishes expiry/nonrenewal from dismissal and addresses cases with a legitimate expectation of renewal. It does not make every repeated contract automatically renewable. Ask a labor professional to assess the actual documents if promised renewal, established procedures, or ongoing work make the situation unclear.
The existing questions to ask about an employment contract help locate the relevant wording, but a pre-signing checklist cannot determine whether a particular nonrenewal is lawful.
Get a final-payment and document checklist
Ask payroll to identify the final wage period, unpaid items, any applicable retirement benefit, each proposed deduction, and expected payment dates. Ask for the calculation rather than a single unexplained settlement figure. Do not sign an acknowledgment that says everything has been paid before checking what it actually covers.
Labor Standards Act Article 36, in the version effective October 8, 2026, generally requires wages and other money due to be settled within 14 days of the payment-triggering event following departure, while allowing an agreed extension for special circumstances. Ask how this applies to the disputed item and dates in your case.
Request the documents your next employer or receiving institution actually needs. Keep final payslips and payment evidence privately. Agree on equipment return and access closure, with a receipt or confirmation where appropriate.
Escalate a specific unresolved question
Take the contract dates, renewal record, employer message, and outstanding payment list to MOEL or a qualified labor adviser. If your stay permission depends on the employment, separately confirm the immigration steps for your status; the contract end date alone does not explain them.
You can use Korea Work Desk's workplace tasks workspace to organize questions for HR. Keep the actual contract and identity documents in your own secure records.
